Financial provision

Starting their new life with the assets and income they need to move on positively and securely is an important goal for anyone going through divorce. Resolving the financial aspects of divorce is a key part of the work done by our leading family team, who work hard to ensure that a settlement is reached that is tailored to each client and meets their individual requirements.

Many of our clients, and their husbands and wives, operate their finances in complex ways, using trusts, companies and overseas vehicles to protect and preserve their wealth. Our family lawyers have a wealth of experience in dealing with these structures and the additional tax issues and legal complexities that they bring. Our partners regularly lecture on such issues and Michael Drake is co-author of the respected ‘Divorce and the Family Business’.

Reaching a financial settlement does not have to be contentious and our lawyers have considerable experience of using ‘alternative’ dispute resolution processes such as mediation, while several members of our team are trained in collaborative family law. The majority of divorcing couples reach their settlement through negotiation, and our team have been praised for their “diplomatic approach, and always come up with realistic solutions”.

There are times, however, when a tougher approach is needed and our team are all accomplished litigators, who are not afraid to fight hard for their clients when the situation requires it.
